Liability Waiver
INJURY RELEASE AND LIABILITY WAIVER
This Injury Release and Liability Waiver (the "Waiver") is executed on the date electronically accepted by the undersigned participant ("Participant") or, if the Participant is a minor, by the Participant’s parent or legal guardian ("Guardian"), in favor of Reflections Art, its owners, directors, officers, employees, instructors, agents, volunteers, successors, and assigns (collectively, "Company").
**1. Acknowledgment of Risk**
Participant acknowledges and understands that dance and physical movement activities, including but not limited to rehearsals, performances, classes, workshops, and conditioning exercises (the "Activities"), involve inherent risks, including but not limited to bodily injury, falls, strains, sprains, fractures, and other associated risks. Participant acknowledges that such risks may result from their own actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, the facility conditions, or any equipment used.
**2. Assumption of Risk**
Participant voluntarily assumes all risks associated with participation in the Activities, whether known or unknown, and accepts full responsibility for any injury, illness, damage, loss, or expenses that may occur as a result of participation.
**3. Release and Waiver of Liability**
To the fullest extent permitted by law, Participant (or Guardian) hereby releases, waives, discharges, and covenants not to sue Company from any and all claims, liabilities, demands, actions, damages, costs, or expenses arising from or related to participation in the Activities, including but not limited to those caused by the negligence of Company.
**4. Medical Treatment Authorization**
In the event of an injury or medical emergency, Participant (or Guardian) authorizes Company to provide or obtain necessary medical treatment and agrees to be financially responsible for any medical costs incurred as a result of participation in the Activities.
**5. Indemnification**
Participant (or Guardian) agrees to indemnify and hold harmless Company from any and all claims, liabilities, damages, or costs, including attorney fees, arising from Participant’s involvement in the Activities.
**6. Use of Likeness**
Participant (or Guardian) grants Company permission to use Participant’s name, image, likeness, and voice in photographs, videos, or other media for promotional, educational, and commercial purposes without compensation.
**7. Severability**
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
**8. Governing Law**
This Waiver shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
By selecting “agree,” upon registration checkout, Participant (or Guardian) acknowledges that they have read, understand, and voluntarily agree to this Waiver, fully understanding its terms and the rights they are waiving.
